These Terms of Service (“Terms”) govern your access to and use of the Better Together mobile application, website, and related services (collectively, the “Service”) operated by Better Together (“Better Together,” “we,” “us,” or “our”).
By creating an account, downloading the app, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Who may use the Service
You must be able to form a binding contract (or have a parent/guardian’s permission where required in your country) to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Your account
- You are responsible for keeping your login credentials secure and for activity under your account.
- You agree to provide accurate information and keep your profile details up to date.
- You may not impersonate others, create accounts through unauthorized automated means, or share accounts in a way that violates these Terms.
- We may suspend or terminate accounts that violate these Terms or pose a security or abuse risk.
3. The Service
Better Together helps people build positive habits together through time-boxed challenges, check-ins, circles, invitations, and encouragement among people they choose to connect with.
The Service is provided for personal, non-commercial use unless we agree otherwise in writing. Features may change over time. We may add, modify, or discontinue features with reasonable notice when practical.
4. Your content and permissions
You retain ownership of content you submit (such as display names, photos, audio, check-ins, and messages). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your content solely as needed to operate and improve the Service and as directed by your sharing settings.
You represent that you have the rights to content you upload and that your content does not violate law or third-party rights.
5. Acceptable use
You agree not to:
- Harass, threaten, abuse, or harm others
- Post unlawful, deceptive, hateful, or sexually exploitative content, especially involving minors
- Upload or share adult sexual content, pornography, or other material we reasonably classify as inappropriate for a family-oriented habit app
- Spam invitations or use the Service to send unsolicited marketing
- Attempt to access accounts or data without authorization, probe or disrupt our systems, or reverse engineer the Service except where permitted by law
- Use the Service for any illegal purpose
We may remove content, limit features, or terminate access when we reasonably believe a violation has occurred.
6. Invitations and shared activity
When you invite someone by email, phone, or link, you represent that you have a reasonable basis to contact them. Participants in a challenge or circle may see activity you share within that group according to the app’s visibility rules.
You can block or report users and content, decline invitations, and leave challenges or circles at any time, subject to in-app controls. We may use automated tools and human review to enforce these Terms.
7. Subscriptions and purchases
Some features may be offered free and others through paid plans. If you purchase a subscription through the Apple App Store or Google Play, billing and cancellation are handled by that store under its terms. Refund requests for in-app purchases must be directed to the applicable store unless required otherwise by law.
We may offer web or other billing methods in the future; any such purchase will be subject to the payment terms presented at checkout.
8. Health and wellness disclaimer
Better Together supports habit-building and social accountability. It does not provide medical, psychological, nutritional, or other professional advice. Always consult qualified professionals for health decisions. Do not rely on the Service for emergency assistance.
9. Intellectual property
The Service, including our name, branding, software, and design, is owned by Better Together or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding except as needed to use the Service as intended.
10. Third-party services
The Service may integrate with third-party sign-in providers, app stores, and infrastructure services. Your use of those services is subject to their terms and policies. We are not responsible for third-party services we do not control.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee uninterrupted or error-free operation, that defects will be corrected, or that the Service will meet your expectations.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTER TOGETHER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnity
You agree to defend, indemnify, and hold harmless Better Together from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.
14. Termination
You may stop using the Service at any time. You may request account deletion by contacting {{SUPPORT_EMAIL}}.
We may suspend or terminate your access if you materially breach these Terms, if required by law, or if continuing to provide the Service to you creates risk for us or others. Sections that by their nature should survive termination will survive.
15. Dispute resolution
Before filing a claim, please contact us at {{SUPPORT_EMAIL}} so we can try to resolve the issue informally.
These Terms are governed by the laws of the State of Delaware, United States, excluding conflict-of-law rules, except where mandatory consumer protection laws in your country require otherwise.
16. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page and update the effective date. If changes are material, we may provide additional notice in the app or by email. Continued use after changes become effective constitutes acceptance of the revised Terms.
